1.Assumption of Risk. You expressly agree that your use of the Services is at your sole risk. The Services are provided on an “as is” and “as available” basis. You are solely responsible for any decision or action you take based on the information and education provided.
2.Exclusion of Indirect Damages.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FINANZO, ITS PARTNERS, AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF FINANZO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
3.Limitation of Direct Damages.
FINANZO’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL BE LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT OF FEES PAID BY YOU TO FINANZO FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).
4.Indemnification. You agree to indemnify, defend, and hold harmless Finanzo and its partners from any claim, demand, liability, cost, or expense, including reasonable legal fees, resulting from your breach of these Terms or your use or misuse of the Services.
Time Limit for Bringing Claims. You agree that any claim or cause of action arising out of or relating to the use of the Services or these Terms must be brought within one (1) year after such claim or cause of action arose, or it shall be permanently barred.
